We have a rental house and planning to rent to students. Bungalow with three bedrooms upstairs, and a second kitchen and bath in the basement.
There is enough room for two students to live in the large rec room in the basement. We could put up a divider in that room. Just wondering if more than 4 students is legal?

Usually 1 person per bedroom (2 if they are minors) and 2 in the master bedroom. The basement can take 2 more. It's the parking that you have to watch and don't get slammed by the city as having a rooming house.

I think if it is your house and you are renting it as shared accomodation,
that each renter is entitled to their own room, access to a shared bathroom and kitchen. I don't think you can rent the basement to two different people and provide them just a divider. I think you'd have to build two bedrooms,
with the common area being the kitchen and bathroom. You'd have to take one rent, not two, and the people would have to consent to live together. If you want two rents, from downstairs you have to have 2 bedrooms, a divider won't cut it.

It's not that you can't do it. If you want to do it you can see if you are zoned to run a hostile or boarding house. If not, you can apply for an exemption, or even re-zoning. But you may not be successful.
And if you are their may be licsences or permits that you would require to run such and enterprise.

However, if each student wants to have a significant other share their own space, you have a say. And that is legal. They could even have a child, or two. But at some point the limit would be decided by the fire marshal. As there will become an issue to as safety and ability to evacuate the premise.
But with each additional people you allow the renter to share their room,
the more wear an tear, you can charge a bit more for the one room. But you can't charge the second person a rent. You can also limit the number of people that can live in the house.

And of course, you can exploit students and run an illegal establishment.
Life is filled with choices, which ones will you make?

I think it depends on local laws. In the area where I live, NORCAL,
it is 2 adults per bedroom + 1 additional person (in theory they could sleep in the living room). Check with the city or county where you live.

Being a professional student and all, I have seen many a times where 5 =
students have shared a house (even without a second kitchen in the =
basement). I have seen it where each student occupies 1 of the 3 =
bedrooms upstairs, another takes the basement and depending on the =
layout of the house, the living room has been converted into a bedroom. =

Instead of looking at it as 5 students renting the place, look at it as =
5 people living/sharing a house. Is that illegal? No. What is =
important is when you are renting out your space, make sure that each =
person knows about the living arrangements and how many people are =
going to be sharing the accomodation. For example, if your basement is =
large enough for 2 people to share, you may get a lot of replies from =
couples who are non-students or even a mother with a child who is =
looking for low-income housing. These sorts of situations may not be =
appropriate for individuals who are non-students. When it comes time =
for students to choose their living arrangements they realize that you =
have to pay for space and privacy. The more people in the house, the =
cheaper it is. Given that many students are looking for accomodations, =
you should try renting the upstairs and downstairs out as one space =
instead of trying to rent each room individually. Chances are, you may =
get 3-5 friends looking for a place and there may be less opportunity =
for problems down the road (i.e. strangers not getting along with one =
another, having 4-5 separate rental agreements, etc.)
